Whitney Faulkner is a civil litigator at Elam & Burke, with over 20 years of courtroom and investigative experience. She represents clients in a broad range of civil cases, focusing on labor and employment disputes, administrative law, professional liability, and healthcare litigation. Drawing on a career built in high-stakes advocacy, Whitney brings disciplined case analysis, strong motion practice, and a steady courtroom presence to every matter.
Before joining Elam & Burke, Whitney spent 21 years as a prosecutor. Whitney began her career in Washington State at a small firm, then moved to the City of Seattle, where she managed municipal prosecutions and collaborated with law enforcement.
After moving to Idaho, she worked for 18 years at the Ada County Prosecutor’s Office where she had the opportunity to work on all manner of crimes and investigations. Her experience includes general and major felony prosecutions, with a focus on victim-centered crimes and handling serious jury trials.
Whitney earned her J.D. from Seattle University School of Law and her B.A. from Colorado College.
Whitney brings a prosecutor’s perspective to her civil practice, informed by years of evidence-driven case evaluation and investigation. She focuses on matters that benefit from careful factual development and clear decision-making, including employment, administrative, professional liability, and healthcare-related disputes.
Outside of her legal practice, Whitney enjoys spending time with her family and spending time cheering on the sidelines of her children’s sports teams. Born and raised in Alaska and educated in Colorado, she remains an avid skier, valuing time outside as an important balance to professional life.
